OVERVIEW

Welcome to SharpShirts! The terms “we”, “us” and “our” refer to SharpShirts and its operator – work and play s.r.o., a private limited company incorporated under the laws of the Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 405526. SharpShirts operates this store and website, including all related information, content, features, tools, products and services (the “Services”).

SharpShirts is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”) describe your rights and responsibilities when you use the Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

 

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make every effort to display accurate product information. Colors and appearance may vary depending on device or settings.

Descriptions and availability may change at any time without notice. We reserve the right to limit quantities or discontinue products.

This does not limit your statutory legal guarantee if a product is not as described.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order. Your order is accepted only once we confirm it and receive payment.

Because all products are made to order after payment, the 14-day cooling-off right does not apply under EU law to such made-to-order goods. Accordingly, we cannot accept returns for change of mind, wrong size, or similar reasons.

This does not affect your statutory rights regarding defective or non-conforming goods (legal guarantee).

If your item is defective, damaged, or incorrect, contact hello@sharpshirts.store and we will repair, replace, or refund as required by law.

You confirm that your purchases are for personal or household use only and not for resale.

For customers outside the EU, local customs duties or import taxes may apply upon delivery.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is that shown at checkout at the time of order and confirmed by email.

Unless stated otherwise, prices are VAT-inclusive where applicable. All applicable taxes, shipping, and any mandatory fees are displayed before checkout so you can review the total prior to purchase.

You agree to provide accurate and current billing and payment details and authorize us to charge all applicable amounts.

 

SECTION 5 – SHIPPING AND DELIVERY

We aim to deliver within the estimated times shown at checkout, but these are not guaranteed. We are not responsible for delays beyond our control, including carrier or customs delays.

Risk of loss or damage passes to you when you (or your designated person) take physical possession of the goods. If you choose a carrier not offered by us, risk passes when we hand the goods to that carrier.

Ownership of the products passes to you upon delivery.

For customers outside the EU, local customs duties or import taxes may apply upon delivery.

SECTION 6 – INTELLECTUAL PROPERTY

All trademarks, logos, designs, text, graphics, and other content on the Services are owned by SharpShirts or its licensors and protected under Czech and EU law.

You may use the Services for personal, non-commercial purposes only. No license or rights are granted except as expressly stated.

SECTION 7 – OPTIONAL TOOLS

You may access third-party tools through the Services. They are provided “as is” without warranties, and your use is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain links or embedded content from third parties. We are not responsible for their accuracy, content, or policies. Access them at your own discretion.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

SharpShirts is powered by Shopify, but all sales are made directly with SharpShirts. Shopify is not responsible for your transactions with us. You release Shopify and its affiliates from all related claims or liabilities.

SECTION 10 – PRIVACY POLICY

All personal data is processed in accordance with our Privacy Policy.

For data-protection purposes (including GDPR), work and play s.r.o. is the data controller. Shopify acts as our data processor, providing hosting, payments, and infrastructure services and may use sub-processors under appropriate safeguards such as EU standard contractual clauses.

SECTION 11 – FEEDBACK

If you submit feedback, reviews, or ideas, you grant us a worldwide, perpetual, royalty-free license to use and display that content for any purpose. You represent that you own or control the rights to any feedback you provide.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

We may correct obvious errors or inaccuracies at any time. Price or term changes do not affect orders we have already accepted.

If an error is discovered before acceptance, we may cancel the order and will notify you.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to engage in any activity that violates laws, infringes rights, transmits harmful code, or interferes with the operation or security of the Services.

SECTION 14 – TERMINATION

We may terminate or suspend your access to the Services at any time if you breach these Terms. Sections that by nature survive termination (e.g. Intellectual Property, Limitation of Liability, Governing Law) remain in effect.

SECTION 15 – DISCLAIMER OF WARRANTIES

The Services and all products are provided “as is” and “as available,” without warranties of any kind, except as required by law.

Nothing in this Section limits your statutory legal guarantee of conformity for consumer goods (typically 2 years from delivery under EU/Czech law).

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, SharpShirts and its affiliates shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services or products.

Nothing in these Terms excludes or limits liability where it cannot be excluded under applicable law, including liability for death, personal injury, fraud, or your statutory consumer rights.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless SharpShirts and its affiliates, officers, and employees from any third-party claims arising from your unlawful use of the Services or breach of these Terms, to the extent allowed by law.

SECTION 18 – SEVERABILITY

If any provision is found invalid or unenforceable, it will be enforced to the maximum extent possible, and the remaining provisions will remain valid.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any term is not a waiver. These Terms and referenced policies constitute the entire agreement between you and us and supersede prior versions.

SECTION 20 – ASSIGNMENT

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by Czech law.

If you are a consumer residing in the EU, you also enjoy the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of that country where such rights cannot be waived.

SECTION 22 – CONSUMER RIGHTS AND DISPUTE RESOLUTION

Statutory legal guarantee: If your product is not in conformity with the contract, you are entitled to remedies under EU and Czech law (repair, replacement, price reduction, or refund). The legal guarantee typically lasts 2 years from delivery.

Out-of-court resolution (ADR): You may seek ADR with the Czech Trade Inspection Authority (Česká obchodní inspekce – ČOI). More information and forms are available at www.coi.gov.cz.

SECTION 23 – HEADINGS

You can review the latest version of these Terms at any time on this page. We may update them periodically; material changes will be announced in accordance with law. Continued use of the Services constitutes acceptance of the revised Terms.
